The West Virginia Public Service Commission has removed the City of Mullens from an ongoing dispute between the Wyoming County Board of Education and Black Diamond Power Company.
In a procedural order issued November 10, Chief Administrative Law Judge Keith George ruled that the city “has no interest in this proceeding,” leaving the Board of Education as the sole complainant.
The case involves costs to extend electrical service to a new school. The original complaint, filed in September, also sought to have Appalachian Power take over service in Mullens. However, the Commission later clarified that the only issue in this case is the cost of extending service to the school, while a separate investigation will review which utility should serve the area.
No parties objected to removing the city after the Commission questioned its role in the case. The proceeding will now move forward with only the Wyoming County Board of Education and Black Diamond Power Company involved.
The order was served to all parties, including Mullens City Manager Krystal Wallace.
